This website is Intended for use by all above the age of 18 to enjoy, view and shop. Please treat the site with respect and only get in contact for legitimate reasons. Most designs and products made are from original ideas and made by Fire&Wind, with this in mind you cannot download, share or publish any of the imagery, logos, writing, designs or media of any kind on this site without explicit consent from Lukasz Juchniewicz who oversees all branding and social media. We kindly ask if you wish to share any images or media on this site you first get in contact.

 Price and payment

 1.1 Payment of the quoted price is strictly required at the point of customer accepting a design of bespoke product. 

1.2 Production will only begin after the payment is received by Fire&Wind. 

 

2.1 Payment of a price for a ready-made product is strictly required at the point of customer making a purchase. 

2.2 Any ready-made products will be dispatched after the payment has been received. 

 

Delivery

Please contact us before purchase to arrange delivery, delivery is not free.

Most items that are sold on this website are unique, each of which has its own specifications and parameters when it comes to delivery. Therefore, please get in contact for any delivery enquiries about each product. We are happy to help, quote and fulfil deliveries once organised. 

The prices of items in the shop on this website do not include delivery fees, once organised with the customer this will be a separate and additional fee to pay, unless clearly stated otherwise for that product.

 

3.1 Fire&Wind will provide the customer with a dispatch date and estimated delivery date. 

 

3.2 Unless otherwise agreed in writing, delivery of the goods shall take place at the address specified by the buyer on the date specified by Fire&Wind. Customer should make all arrangements necessary to take delivery of the goods whenever they are tendered for delivery. 

 

3.3 Should the customer not be available to take the delivery of goods on previously specified date by Fire&Wind, the customer is liable to pay for any necessary charges relating to re-planned delivery. 

 

3.4 Any delivery failures out of Fire&Wind control do not warrant reductions in price and therefore, refunds.

 

Acceptance

 

4.1 The customer is required to test the goods delivered and shall be deemed to have accepted the goods 14 days after the delivery has taken place. Accordingly, no claim for defect, damage or quality will be entertained unless written notice together with supporting evidence is received by Fire&Wind within 14 days of delivery. After acceptance, the customer shall not be entitled to reject goods which are not in accordance with the contract. 

 

Returns

 

5.1 Where goods delivered are found to be defective, Fire&Wind shall resolve any issues free of charge within the warranty period if acceptable from the date of delivery, subject to the following conditions:

 

    5.1.1 the customer notified Fire&Wind in writing immediately upon the defect becoming apparent. 

    5.1.2 the defect being due to faulty design, materials or workmanship

 

5.2 any goods to be repaired or replaced shall be returned to Fire&Wind at customers expense, if so requested by Fire&Wind.

 

    5.2.1 any goods to be repaired of replaced shall be returned to Fire&Wind within 30 days of acceptance of delivery date, unless agreed otherwise in writing. 

 

5.3 any goods repaired or replaced shall be returned to the customer at Fire&Wind expense, only in instances where defects are adhering to point 5.1.2

 

Force Majeure

 

6.1 The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations. If the delay persists for such time as the Seller considers unreasonable, it may without liability on its part, terminate the contract or any part of it.
